Personal Injury in Auto Accidents are civil suits against the person who caused the accident to obtain an award of damages.  Our office will try to prove that the driver of the other vehicle caused the accident and did not act with reasonable care.   In an auto accident personal injury claim three criteria must be met:

  • The legal duty to use care:  Operated the vehicle at a reasonable speed and maintained control of it
  • A violation of that duty:  Failed to operate the vehicle at a reasonable speed and failed to maintain control

Felonies carry a longer jail/prison time, formal probation, fines and fees, and other forms of punishment.

Traffic Violations are generally infractions and less serious of all charges.  Traffic violations are speeding tickets, red light violations, parking in handicap zone, driving without a license and drag racing. 

Traffic violations do not carry any probation or jail time and require paying fees and penalties.  However, the more significant effects of such violations are DMV points, increase in insurance premiums, and in some cases losing driving privileges.

Misdemeanors are less serious crimes, including but not limited to petty theft, domestic violence, simple assault, disorderly conduct, trespass, certain sex crimes, DUI/DWIs, prostitution, Marijuana charges, certain driving violations such as reckless driving, exhibition of speed and unlicensed or suspended license driving, and much more.

Misdemeanors generally show up in a background check and can be expunged through a process, if eligible.

Misdemeanors carry a six month to one year jail time, summary probation, community service, community labor, penalties and other forms of punishment.

Our office will negotiate with the prosecutor to lessen the penalties and make a difference between jail time and a fine.
